Mediation – Helping Advisors and Accountants understand the mediation process in dispute resolution
The session will be overseen by Kevin Bailey
Kevin Bailey is the founder of Business Remedies Ltd and an experienced mediator with more than 30 years’ experience across commercial banking, finance, restructuring and dispute resolution. His mediation work focuses particularly on commercial, rural and financial matters, helping parties navigate disputes and work towards practical outcomes.
This month we will cover “Mediation – Helping Advisors and Accountants understand the mediation process in dispute resolution“
Kevin will provide an overview of how to recognise when mediation might be appropriate and how it works in practice, with a particular focus on business and commercial disputes involving shareholders, lenders/investors, clients, staff/contractors and other stakeholders.
The session will explain what parties can expect when they engage a mediator, how the mediation process unfolds, and the practical techniques mediators use to help parties navigate conflict, explore underlying interests and work towards resolution. It will also cover the role of advisors in mediation.
In this webinar, Kevin will cover:
- Understand how mediation works in practice and the role of the mediator: Explore the mediation process, the role of the mediator, and what parties can expect before, during and after a mediation.
- Understand the mediation experience: Consider how parties prepare for mediation, how issues are identified and discussed, and how negotiations and potential agreements develop during the process.
- Consider the role of advisors and accountants: Explore how professional advisors can support their clients through mediation, contribute to constructive discussions and avoid becoming unnecessarily drawn into the dispute.
- Recognise when mediation may be appropriate: Consider common business-conflict scenarios and the circumstances in which engaging a mediator may assist parties in addressing their differences.
-
After the discussion, connect with other advisors in small groups to exchange insights, share experiences, and brainstorm ways to apply these techniques in your practice. Networking is a powerful tool for growth, and this session is designed to help you build valuable relationships within the advisory community.
